Virginia: New Warranty and Recall Protections for Dealers Signed into Law

A new law was signed earlier this year to take effect July 1, 2025, in Virginia, providing protections to ensure fair reimbursement for Virginia’s automotive technicians and dealerships performing warranty and recall repairs. 

Dealer protections include:

  • Manufacturers will no longer have the ability to challenge warranty rates based on their definition of reasonableness
  • Protection from decreases in markup on recall repair parts
  • The ability to return unused recall parts
  • Strengthened protection for payment for diagnostic repair time

Maryland HB1046: Vehicle Service Contract Technical Service Bulletin Restrictions Effective October 1, 2025

Maryland House Bill 1046, signed into law on April 22, 2025, and effective October 1, 2025, protects consumers by prohibiting certain practices, including:

  • Mechanical repair contracts cannot exclude coverage solely because a technical service bulletin identifies the issue
  • Vehicle Service Contract obligors/providers denying claims solely based on repairs being listed in technical service bulletins

This law significantly protects consumers by preventing certain coverage exclusions in vehicle service contracts.

Arizona Substantive Policy Statement 2025-03 (INS)

Arizona’s Department of Insurance and Financial Institutions recently issued a Bulletin to address unpermitted entities that appear to be engaging in conduct that may require a permit issued by the Department under Arizona law. This Bulletin is intended to guide insurers on complying with Arizona Service Contract regulations.

The Department emphasizes that entities offering service contracts must obtain a service company permit. 

The Department has observed a number of insurance contracts that include coverages for individual consumer products that meet the definition of a service contract under Arizona law. See A.R.S. § 20-1095(7). The coverages are being provided by insurers that have not obtained the required permit to offer service contracts. See A.R.S. § 20-1095.01.

Washington State Service Contract Provider Update

Effective July 27, 2025, Washington State will allow service contract providers to use multiple reimbursement insurance policies (CLIP) as forms of indemnity.

Service contractor providers may now use more than one reimbursement insurance policy (CLIP) as a form of indemnity. A service contract must be insured by only one CLIP. You can’t insure the same service contract on more than one CLIP; however, you can use multiple CLIPs to cover the same category of service contract.
