Blurred Lines: Another Case of Service Contract v. Warranty v. Insurance Confusion

In a brand new opinion, the Oklahoma Supreme Court in Sparks v. Old Republic Home Protection Co., Inc. [1] held that what appeared (and was likely intended) to be a “service contract” was actually an insurance contract by way of also being a warranty, thereby preventing enforcement of an arbitration clause in the contract. Oklahoma Court: Home Warranty Contract Is Insurance; Forced Arbitration Not Allowed

A home warranty contract is an insurance contract.

That’s the conclusion of the Oklahoma Supreme Court in a case in which the plaintiffs challenged a mandatory arbitration provision in a home warranty contract, maintaining such provisions are not legal under state law in any contract that references insurance.
